A) Booking Services:
This agreement, concluded between the Customer identified above and to Transport Cars Corp , refers exclusively to Transport Cars Corp as booking agent of the Client for facilitating the booking with a Carrier. The Client acknowledges that Transport Cars Corp negotiated previously certain fees with providers in order to facilitate these reserves and that the overall rate displayed on the listing includes both the rate of pre-negotiated carrier as the booking fee retained by Transport Trucks Corp for their services. All prices are in us dollars. By accepting this agreement, the Client authorizes to Carry Cars Corp to charge the booking fee, or the total price of the reservation on your credit card, as specified in the Agreement of disclosure of payment. Transport Carts Corp acting as agent for the Client to try to book with a Carrier to maintain a safe, based on Certificates of Insurance provided by the Company.
(B)Scheduling and Delays:
Transport Carts Corp does not guarantee the availability or performance of specific dates for the submission, and will not be liable for any loss or damage due to delays for any reason. The dates for pick up and delivery are estimates and may vary. The Customer must provide an extra margin of up to 5 business days after the dates of the initial reserve for possible reprogramming. Additional charges for guaranteed dates will not be refunded.
(C)Liability and Claims:
Any claim shall be addressed to the Carrier or its insurance policy, without exception. The Client shall Carry Cars Corp harmless of any claim. Transport Carts Corp will not be responsible for damage caused by chance events or defective parts of the vehicle. The Client is responsible to remove and secure any loose part from the vehicle during transport.
D)Collection and Delivery:
The Client must be available for pick-up and delivery as scheduled. The delays due to the lack of availability of the Customer may be subject to a fee of reprogramming. Payments to the Carrier must be made in cash, cashier's check or money order, unless otherwise agreed. The Customer is responsible for all costs of storage and delivery if you can not accept the delivery for any reason.
(E)Specific Conditions:
Additional charge will apply if the vehicle does not comply with the specified dimensions. Transport Carts Corp reserves the right to terminate the agreement in the event of discrepancies. In case of cancellation on the part of Transport Cars Corp, we will apply the refund policy and cancellation.
F)Cancellations and Refunds:
Cancellations must be made in writing. Apply to administrative fees for certain types of cancellations.
G)Agreements with Other Agencies:
This agreement is exclusively between the parties and no arrangements can be made concurrent with other agencies of the booking without notice and cancellation prior to Transport Cars Corp. Transport Carts Corp reserves the right to cancel the booking request if you make an agreement with another agency during the term of this agreement. The Customer must comply with the terms of cancellation and refund are specified in this document.
H)Conflict Resolution:
The parties agree to resolve any dispute in accordance with the terms of this agreement. This agreement prevails over any verbal statement made by the employees of Transport Cars Corp at any time.
(I)Confirmation and Jurisdiction:
By signing physically or electronically, of this agreement, the Customer confirms the reading, understanding and unconditional acceptance of the terms and conditions. This agreement shall be construed and governed in accordance with the laws of the State of Florida. Any dispute shall be resolved in the courts of West Palm Beach-Palm Beach County, Florida.
(J)Entire Understanding:
The Customer confirms that it understands and accepts the terms and conditions of this agreement. Any other prior agreements or verbal, shall take effect without notice and cancellation to Transport Cars Corp.
K)Limits and Obligations:
The Customer agrees to the limitations of liability and the obligations set forth in this agreement. Transport Carts Corp will not be responsible for any loss or damage caused by chance events or defective parts of the vehicle.
(L)Legal Authority:
Transport Carts Corp reserves the right to take legal action if necessary to enforce the provisions of this agreement or to defend their interests. The Customer will be responsible for all legal costs, and attorneys fees incurred by Transporting Cars Corp in the event of a dispute.
